365 CGM Terms of Service

1. Overview
365 CGM is a personal-use software service that helps you view glucose information, related events, and optional Nightscout sync data. These Terms govern your access to and use of the service.
By using 365 CGM, you agree to these Terms.
2. Eligibility and invited access
You may use 365 CGM only if:
- you are legally able to enter into these Terms;
- you have been invited or otherwise authorized to use the service; and
- you use the service only for lawful purposes.
You are responsible for ensuring that your use of the service is permitted in your location and in your care setting.
3. Medical and emergency limitations
365 CGM is not medical advice, is not a medical provider, and is not an emergency service.
You must not rely on 365 CGM as your sole source for treatment, diagnosis, dosing, or emergency decision-making. If you believe you may be experiencing a medical emergency, call emergency services immediately and follow the instructions of licensed clinicians and the manufacturers of your medical devices.
4. Your account
You are responsible for:
- keeping your account credentials confidential;
- ensuring the Eversense and any connected Nightscout information you provide is accurate;
- promptly reporting suspected unauthorized access; and
- logging out or requesting account disablement if you believe your account is compromised.
You may not share your account except as explicitly permitted by us.
5. Connected services
365 CGM may connect to third-party services, including Eversense systems and Nightscout servers. Those services are not controlled by 365 CGM.
We are not responsible for:
- the availability, security, accuracy, or uptime of third-party services;
- delays, gaps, or formatting changes in data returned by those services; or
- any actions taken by those providers regarding your account.
Your use of those services remains subject to their own terms and privacy policies.
6. Acceptable use
You may not:
- use the service in a way that violates law or regulation;
- attempt to access other users' data;
- interfere with or disrupt the service;
- reverse engineer, scrape, or abuse the service in a way that harms availability or security;
- use the service to develop competing access paths or derivative infrastructure without permission; or
- use the service in any high-risk setting where failure could reasonably be expected to cause death, bodily injury, or material property damage.
7. Monitor links and sharing
If you create a read-only monitor link, anyone with that link may be able to view the glucose and event information exposed by that link.
You are responsible for deciding whether to create, share, or revoke a monitor link. Treat monitor links as sensitive.
8. Service changes, suspension, and termination
We may change, suspend, or discontinue parts of the service at any time. We may disable or terminate access if we reasonably believe:
- your use violates these Terms;
- your account creates security, legal, or operational risk; or
- continued access could harm the service or others.
You may stop using the service at any time. Account deletion requests are handled through the product's account controls.
9. Data retention and deletion
We retain data according to the product's Privacy Policy and operational needs, including security, troubleshooting, audit, and synchronization needs. If you request account deletion, we will attempt to delete or de-identify retained data consistent with our systems and legal obligations.
10. No warranty
365 CGM is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability.
We do not warrant that:
- glucose values, trends, or related events will always be accurate, current, complete, or timely;
- synchronization with Eversense or Nightscout will always succeed; or
- the service will be free of defects, downtime, or security incidents.
11. Limitation of liability
To the maximum extent permitted by law, 365 CGM and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or related to the service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the service will not exceed the greater of:
- the amount you paid us for the service in the 12 months before the claim; or
- US $100.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnity
You agree to defend, indemnify, and hold harmless 365 CGM and its operators from claims, liabilities, damages, losses, and expenses arising from your use of the service, your violation of these Terms, or your infringement of any rights of another person or entity.
13. Governing law and disputes
These Terms are intended to be interpreted under the laws designated by the service operator. If counsel has not yet specified a governing law or dispute process, the service operator may designate those terms in a future update.
14. Changes to these Terms
We may update these Terms from time to time. When we publish a new legal release, you may be required to review and accept the updated Terms before continuing to use the service.
